Encinitas tees up platform TOT + permit overhaul
What's happening: Encinitas City Council meets Wednesday, Sep 23 at 6:00 PM PT at City Hall (505 S Vulcan Ave) for a public hearing and first reading of Item 12D — Ordinance 2026-15.
Two moves in one package:
- Permit cleanup (Title 9): Brings forward the Dec 2022 enforcement package that does not need Coastal Commission certification.
- Renewals go from annual to every 3 years.
- Permits can be revoked after 12+ months of inactivity, tracked through TOT.
- Clearer rules for curb-visible permit posting.
- "Duplex" language updates to "two-family dwelling."
- Platform rules (local SB 346 invoke): Airbnb/Vrbo-class facilitators must:
- Put STR permit numbers and TOT certificate numbers on listings.
- Collect and remit TOT to the city.
- File quarterly or monthly reports with address, APN, listing URL, nights, and gross per reservation.
- The city can audit facilitators and fine noncompliance. Operators stay liable if a platform fails to remit.
Why it matters: This is compliance modernization, not a new cap. If you already hold a valid permit and remit TOT correctly, platform remittance should reduce self-reporting friction over time. If a listing is unpermitted, idle, or under-reported, it gets easier for the city to find.
Catch up — what's not on Wednesday's agenda: The Coastal Commission LCP package (caps, spacing, night-minimum fights) is not part of Item 12D.
